By accessing or using KinPhotos, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our service.
KinPhotos provides photo digitization, metadata tagging, and private online gallery hosting services for families. We scan physical photographs and host the resulting digital files on your behalf.
You are solely responsible for all content you submit to KinPhotos, including photographs and any associated metadata. You represent and warrant that you own or have the necessary rights to all content you provide, and that your content does not violate any third-party rights or applicable laws.
You may not upload, store, or share content that is illegal, harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable. This includes but is not limited to: content that violates copyright or intellectual property rights; content depicting child exploitation or abuse; content that promotes violence, hatred, or discrimination; and content that violates any applicable local, state, national, or international law. We reserve the right to remove any content that violates these terms and to terminate accounts of users who repeatedly or egregiously violate them.
You retain full ownership of all photographs and content you submit. By using our service, you grant KinPhotos a limited license to store, process, and display your content solely for the purpose of providing the service to you.
Your use of KinPhotos is also governed by our Privacy Policy, which is incorporated into these terms by reference. Family galleries are private by default and accessible only to invited members.
We implement reasonable technical and organizational measures to protect your content. However, no method of transmission or storage is 100% secure. We cannot guarantee absolute security of your data.
We strive to maintain continuous service availability but do not guarantee uninterrupted access. We may modify, suspend, or discontinue the service at any time with reasonable notice.
To the maximum extent permitted by applicable law, KinPhotos shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service. Our total liability for any claim arising from your use of the service shall not exceed the amount you paid us in the twelve months preceding the claim.
You agree to indemnify and hold KinPhotos harmless from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the service, your content, or your violation of these terms.
We may update these terms from time to time. We will notify you of significant changes by email. Your continued use of the service after changes take effect constitutes your acceptance of the updated terms.
